Subject: Urgent: Please Pass S.5196 / A.2128 to Protect NY Youth

Message:

As your constituent and a volunteer with Parents Against Vaping, a national grassroots organization powered by parent volunteers like myself, I urge you to pass S.5196 (Hoylman-Sigal) / A.2128 (Rosenthal), good bills that would protect our children from the tobacco/vape industry by eliminating loopholes in New York’s flavored e-cigarette law. In 2019, New York passed legislation to end the sale of flavored e-cigarette products, but of the states with similar laws, we have the highest retail availability of these products. Vague language and several other loopholes in the existing law have made it possible for retailers to deny retail inspections, keep flavored e-cigarettes in stock on-site, and allow distributors to sell and ship these products to stores across New York. Additionally, existing legislation allows exemptions for products given a designation of “Pre-market Tobacco Product Authorization (PMTA)” by the FDA. This loophole creates gray areas as to what products may be legal or illegal, creating confusion among retailers and their customers, as well as those tasked with enforcement. We need to put an end to the easy availability and promotion of these deadly products. S.5196 / A.2128 would help us take a huge step toward decreasing tobacco initiation and youth use by providing local health departments with the clear enforcement authority they need to crack down on illegal flavored vape sales and hold retailers accountable. Please pass S.5196 / A.2128 this session and send a clear message that our lawmakers prioritize the health and well-being of New York children and their families. Thank you.
